YouWorking Terms of Service

These Terms of Service (“Terms”) govern access to and use of the YouWorking hiring platform (the “Service”), operated by Cram Cards LLC (“YouWorking,” “we,” “us”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you are accepting these Terms on behalf of a business, you represent that you have authority to bind that business, and “you” refers to that business.

If you are a job Candidate who was invited to record an interview or who applied through a public apply link, Section 9 (“Candidates”) applies to you specifically.

1. The Service

YouWorking helps employers import, score, and rank job applicants, and lets candidates complete a self-recorded, AI-assisted screening interview instead of a live phone or in-person screen. Employers can upload resumes directly or collect them through a public apply link. Scores, summaries, flagged concerns, and interview highlights are generated with the help of automated and AI systems and are provided to assist, not replace, the employer’s own hiring judgment. YouWorking does not make hiring decisions and does not guarantee any outcome of a hiring process.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity under your account. You must be at least 18 years old to create an Employer account.

3. Subscriptions, Fees, and Billing

Certain features require a paid subscription, billed annually through our payment processor, Stripe, at the price displayed to you at checkout. Subscriptions renew automatically each year unless canceled before the renewal date. If you cancel, your subscription remains active through the end of the period you already paid for, and you will not be charged again; we do not provide refunds for partial periods except where required by law. We may change our pricing for new or renewing subscribers; where we do, we will disclose current pricing before you are charged.

4. Your Content and Data You Submit

“Customer Data” means the job postings, scoring criteria, resumes, and other information you or your organization submit to the Service, including resumes and interview recordings of Candidates you invite or upload. You retain ownership of Customer Data. You grant us a license to host, process, transmit, and analyze Customer Data solely to provide the Service to you (including sending it to the third-party AI, transcription, and infrastructure providers described in our Privacy Policy).

4.1 Your responsibility for Candidate data

If you upload a candidate’s resume or other personal information directly, you represent and warrant that you have the legal right to submit that information to us and to have it processed as described in our Privacy Policy, including any consent or notice required under applicable employment, privacy, or AI-hiring-disclosure laws in your jurisdiction (for example, Illinois’ AI Video Interview Act or New York City’s automated employment decision tool law, where applicable to you). You are solely responsible for complying with employment, anti-discrimination, and data protection laws that apply to your own hiring process, YouWorking is a tool you use in that process, not a substitute for your own legal compliance.

5. Acceptable Use

You agree not to:

Use the Service to discriminate unlawfully against any candidate, or to make hiring decisions based solely on AI output without the human review the Service is designed to support;
Upload resumes or record interviews of individuals without a lawful basis to do so;
Use the Service to record or screen anyone under circumstances prohibited by applicable wiretapping, surveillance, or biometric privacy law;
Reverse engineer, scrape, or attempt to extract the underlying models, rubrics, or source data of the Service beyond normal use of its features;
Use the Service to send unsolicited communications, or to interfere with its normal operation.

6. AI-Generated Output

Scores, summaries, red-flag detections, retention-risk indicators, and interview highlights are generated by automated systems and may contain errors, omissions, or bias inherent to the underlying AI models. This output is provided for decision support only. You are responsible for independently reviewing candidates and for the hiring decisions you make; you may not rely on AI-generated output as your sole basis for any adverse employment decision.

7. Intellectual Property

We own the Service, including its software, design, rubric templates, and branding. Except for the rights granted to you to use the Service under these Terms, no other rights are granted.

8. Confidentiality

Each party will protect the other’s non-public information shared in connection with the Service with the same care it uses for its own similar information, and will not disclose it except as needed to provide or use the Service, or as required by law.

9. Candidates

If you are a Candidate using the Service to apply for a job or record an interview: your participation is voluntary, submitting an application or completing an interview does not guarantee you will be contacted, interviewed further, or hired, and the hiring organization, not YouWorking, makes that decision. The consent screen shown to you before recording an interview, and our Privacy Policy, describe how your recording is used. Nothing in these Terms creates an employment relationship between you and YouWorking.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED SCORES OR ANALYSIS ARE ACCURATE, COMPLETE, OR FREE OF BIAS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUWORKING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY HIRING DECISION YOU MAKE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

12. Indemnification

You agree to indemnify and hold YouWorking harmless from any claim arising from: (a) your violation of these Terms, (b) Customer Data you submit, including any claim that you lacked authority to submit a candidate’s information, or (c) any hiring decision or employment action you take, including any claim that such a decision was discriminatory or otherwise unlawful.

13. Termination

You may cancel your subscription at any time; access continues through the end of the paid period. We may suspend or terminate your access if you materially breach these Terms, including the Acceptable Use section, and we may retire or modify features of the Service with reasonable notice.

14. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules, and any dispute will be resolved in the state or federal courts located in Washoe County, Nevada, unless applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, for significant changes, provide additional notice before they take effect.
